论实行行为的规范限缩

摘  要: 实行行为是现代刑法理论的核心概念,具有形式侧面和实质侧面。形式侧面存在观念论二元论哲学观与存在论哲学观两种不同的理解,实质侧面则存在主观说、抽象危险说、具体危险说与客观危险说的对立。当前刑法理论与司法实践倾向于从“一般人标准”的经验性路径探究实行行为的范围,但经验性路径存在方法论和实体上的缺陷,实行行为的限缩最终仍需求助于规范的保护目的。规范保护目的的实质在于利益衡量与政策选择,而主观解释基于自由主义的立场,出于实现法的安定性的考虑,相较于客观解释具有不可逾越的优越性。

On the normative restrictions of perpetrating act

Abstract: The perpetrating act is the core concept of modern criminal law theory, with both formal and substantive aspects. On the formal side, there are two different understandings of the conceptual dualism: philosophical view and the existential philosophy view. On the substantive side, there are opposites among subjective theory, abstract danger theory, specific danger theory and objective danger theory. At present, criminal law theory and judicial practice tend to explore the scope of perpetrating act from the empirical path of "general standard". However, there are methodological and physical defects in the empirical path. The normative restrictions of perpetrating act still need to call for help from the normative protection purpose. The essence of normative protection purpose lies in the measurement of interests and policy choices, while the subjective interpretation is based on the position of liberalism. In view of the stability of the realization of the law, it has insurmountable superiority compared with objective interpretation in exploring the normative protection purpose.
