我国现阶段劳动关系中利益失衡问题的伦理思考

摘  要: 劳动关系双方利益失衡是现阶段实现和谐劳动关系的主要障碍。从伦理视角分析,利益失衡的主要原因包括三个方面,一是法律矫正力度不足,这是造成利益失衡的外在约束缺失;二是社会对于公平正义价值目标的忽视,这是造成利益失衡的价值观缺陷;三是企业伦理构建缺失,这是造成利益失衡的企业内在约束缺陷。因此,在充分认识《劳动合同法》对平衡劳动关系双方利益的作用的基础上;政府作为社会利益协调方,应注重从多个角度促进社会主流价值观的进步与完善;企业作为劳动关系协调的自主方,应通过企业伦理构建主动营造合作  氛围。

Thoughts on Imbalance of Interests in Labor Relations in Our Country at the Present Stage from Ethic Perspective

Abstract: The imbalance between the interests of both sides of labor relations is the main obstacle to realize a harmonious labor relationship at the present stage. From ethical perspective, the main reason for the imbalance of interests lies in three aspects. Firstly, the corrective functions of the relevant laws and regulations are not effective, which lacks external constraints; Secondly, the social negligence of the value of fairness and justice, which is the values of defects; Thirdly, enterprise ethics has not been built well, which lacks internal constraints. This article puts forward three suggestions: firstly, the Labor Contract Law’s legal support for labor relations in positive-sum game should be fully realized. Secondly, the government, as the coordinator of social interests, should lay stress on promoting the social mainstream values’ progress and improvement from multiple perspectives. Thirdly, enterprises, as autonomous side in the coordination of labor relations, should take the initiative to create an atmosphere of cooperation by building up enterprise ethics.
